By removing language from President Reagan’s 1983 Executive Order 12425, this international law enforcement body now operates on American soil beyond the reach of our own top law enforcement arm, the FBI, and is immune from Freedom Of Information Act (FOIA) requests. …

After initial review and discussions between the writers of this analysis, the context was spelled out plainly.

Through EO 12425, President Reagan extended to INTERPOL recognition as an “International Organization.” In short, the privileges and immunities afforded foreign diplomats was extended to INTERPOL. Two sets of important privileges and immunities were withheld: Section 2© and the remaining sections cited (all of which deal with differing taxes).

And then comes December 17, 2009, and President Obama. The exemptions in EO 12425 were removed.

Section 2c of the United States International Organizations Immunities Act is the crucial piece.

Property and assets of international organizations, wherever located and by whomsoever held, shall be immune from search, unless such immunity be expressly waived, and from confiscation. The archives of international organizations shall be inviolable. (Emphasis added.)

Inviolable archives means INTERPOL records are beyond US citizens’ Freedom of Information Act requests and from American legal or investigative discovery (“unless such immunity be expressly waived.”)

Let's scare the kids this Christmas

The popular chain Build-a-Bear has a cartoon on their website aimed at children saying that the North Pole (Santa’s home) will be gone in two days…below is the dialogue from the short cartoon…

Girl Elf: Santa, it’s gone!
Papa Elf: It’s gone, It’s gone!
Santa: What’s gone?
Girl Elf: Tell ‘em, Dad!
Papa Elf: The North Peak.
Santa: A mountain? Col. Allen West

Greetings friends, hope everyone had a Happy Hanukkah and Merry Christmas to you all. It’s been a while since I sat and shared the W3 (West Weekly Wrap-up) report with you. I must tell you, since I boarded a plane on November 29th for Israel, it has been a whirlwind. So as 2009 winds down, let me catch you up on the campaign happenings as we begin our journey towards victory in 2010.

Let’s begin with my trip to Israel where I was a speaker at the 2009 Israel Gateway/Safe Cities conference in Tel Aviv. My topic of discussion for the conference was “Global security effects upon local municipalities”. My point was that local law enforcement in America now finds itself dealing with threats outside the routine range of expertise for which they have been trained. We are seeing more and more impacts from Islamic terrorism, illegal immigration (unsecured borders), and infiltration of international gangs. I addressed how in my city of Plantation in 2001, Mohammed Atta, one of the 9-11 hijackers was picked up on a routine traffic stop, but was released and the rest, of course, is tragic history.

The Israeli National Police has been focused on the issue of combating terrorism within its steadily shrinking borders. However, the local municipalities there are seeking more involvement in day to day law enforcement activities, some of which I witnessed during a behind the scenes security tour of Israel. There is a rise in crime in Israel and the police there have an intricate balancing act dealing with both day to day crime and the threats of terrorism. However, it is the same balancing act which our police forces face here in America as more terrorism task forces are created at the local levels to deal with the ever present threats facing our nation.

The rest of my time in Israel was phenomenal. To walk the via Dolorosa, path of Jesus to Golgotha and then stand at that place was simply the most spiritual event I have ever experienced. No matter your religious beliefs, soaking in the history that exists in that part of the world is something that everyone should experience someday and for me, it was a spiritually fulfilling trip. Incredibly memorable for me were two other visits: first, Masada where I stood and looked out over the desert and the Dead Sea as Eleazar and the Jewish supporters did facing the Roman Legions. I have always known the story but to have my feet on that hallowed ground was inspiring…for those of you who do not know the story of Masada, please, take a moment to read about it. Standing there it suddenly struck me, the spirit of Masada was captured in the early days of our country by a patriot named Patrick Henry, “Give me Liberty or Give me Death”.

The second awe inspiring visit was to a simple place called Kibbutz Yad Mordecai. It was there for 6 days in May 1948 where Jewish settlers of the newly formed state of Israel fought back the Egyptian army invaders seeking their destruction. At that battle, which the Egyptians believed would only be a few hours, the Jewish settlers inflicted 400 casualties while only suffering 26. They did withdraw, only to reform their defenses near Ashkelon and, after inflicting another 500 casualties on the Egyptians, the invading army lost the initiative and withdrew. At Kibbutz Yad Mordecai there is a memorial with a simple epithet, “As much as one can withstand, we withstood”. The spirit of freedom and determination can be found in that simple phrase. Those of us who still believe in a strong America can withstand the dismaying news coming from our failed leaders in Washington DC knowing that we will all be united to restore responsibility and proper government to our capitol.

I left Israel committed to the indomitable spirit of Masada and Kibbutz Yad Mordecai, to the preservation of the state of Israel, and to the people of the Holy Land without which my spiritual being would not exist. To Hizbullah, Hamas, Muslim Brotherhood, Islamic Jihad, Al Qaeda, Al Quds brigade, Al Aqsa brigade, Syria, and Ahmadinejad I have one thing to say: threaten Israel at your peril because Israel has no greater friend than America.

Upon my return to the U.S., I found that there was a video of me on YouTube going viral. It was only 6 minutes long and done at the Revolution club in Ft. Lauderdale back in October. As a result of that video, we have appeared on the Sean Hannity show, Laura Ingraham radio show, and had a piece about our campaign in the Weekly Standard, found here. The comments and response to the video has been absolutely overwhelming, and we are driving the liberals crazy. Too often in the past few years, there have been many in the media and in government who have declared conservative values to be simplistic or not sophisticated enough for today’s problems. I believe the problems of this nation have occurred because we’ve too often strayed from the ideas and values that made this the greatest nation in the world and I believe it is time we return to the ideas of John Adams, Thomas Jefferson, James Madison, George Washington and our founders. Politicians like Ron Klein and Nancy Pelosi offer you bloated, wasteful government and control of your health care and your lives while damaging our economy, weakening our dollar and placing us deeper in debt. Whom do you trust? The values and ideas on limited government espoused by Adams and Washington and exhibited by conservatives? Or the values and ideas of Klein and Pelosi that waste your money, grow an already too large federal government and take our freedoms? I know where I stand. Stand with me on the side of history and on the side of responsible, limited government and join our campaign at www.AllenWestforCongress.com. You can no longer afford to remain on the sidelines and hope for the best. These times call not for the “sunshine patriot”, but for the spirit of American independence to return.

2010 is about to be upon us and this race is about us, our campaign and our great country. Principles, leadership, policies and all of you will help guide our efforts. I will leave the empty politics for those like Ron Klein and Nancy Pelosi. We must win this Congressional race and restore American freedoms and responsible government while ending the liberal legislative agenda of “stimulus” waste and health care takeovers. That is our goal and I ask you to help join the team!

Steadfast and Loyal,

Harry Reid (D-Nev) had paid off Sen. Mary Landrieu (D-La) last month. Put enough money on the table and just about any Democratic U.S. Senator will think, gulp, blink, and drag the pot with the rationalization that ‘this is all for the greater good.’ Pelican Pellets. This is no different than putting a horse’s head into Jack Woltz’ bed to force him into giving Johnny Fontaine a part in his movie in The Godfather. It was a deal Nelson couldn’t refuse. There is no Socialized Option in the bill. Abortions will not be covered. It is unclear who will have to pay how much or when for what coverage. All in all it is health care reform that has nothing to do with health care and contains little, if any, reform.
Tensions prevailed at the climate talks at Copenhagen today, as Indian prime minister Manmohan Singh and China premier Wen Jiabao walked out of the summit along with their respective delegations, as talks failed.

Tim Jones, a spokesman for the World Development Movement, said: “The president said he came to act, but showed little evidence of doing so. He showed no awareness of the inequality and injustice of climate change. If America has really made its choice, it is a choice that condemns hundreds of millions of people to climate change disaster.”

Friends of the Earth said in a statement, “Obama has deeply disappointed not only those listening to his speech at the UN talks, he has disappointed the whole world.”

The World Wildlife Fund said Obama had let down the international community by failing to commit to pushing for action in Congress: “The only way the world can be sure the US is standing behind its commitments is for the president to clearly state that climate change will be his next top legislative priority.”

I’ve never believed that problems largely created by the government will be remedied by more government. This is certainly true as it relates to health care reform. Unfortunately, more government is exactly what Congress and the Obama administration are prescribing.

Our government has prevented health insurance from operating as a true market for decades by favoring employer based health insurance through our tax law and preventing interstate competition by insurers. This has led to ballooning health care costs and insurance premiums.

Congress’ intentions sound good: reign in runaway medical costs, and increase access to health insurance. But we don’t measure public policy in good intentions, we measure in results.

According to a new study released by the Centers for Medicare and Medicaid Services (CMS), the independent agency that overseas Medicare and Medicaid, Obamacare would actually increase medical costs over the next decade by $289 billion. CMS also estimates that about 12 million Americans will lose their private insurance should the House plan become law.

Of those Americans who actually gain health insurance under the House plan, CMS estimates that more than half (nearly 21 million) will receive it through Medicaid. Yes, you read that correctly. Most of the newly insured will not be participants in a “public option” or a federal health care exchange. They’ll simply be added to federal welfare rolls. What is being advertised as health care “reform” is actually a massive expansion of the welfare state. That’s not reform, and Medicaid is a poor substitute for health care.

I could go on to discuss the $700 billion in new taxes levied by the House bill, or the fact that taxpayers are still forced to pay for abortions under the Senate’s plan, or the massive addition to the national debt that this “reform” will inevitably dump on future generations. But we shouldn’t miss the forest for the trees.

The Obama administration and liberals in Congress are once again using a “crisis” to increase the size and power of the federal government. Americans must realize that this debate is not just about the future of our health care, it’s about our essential liberties.

Consider for a moment that the various health care reform bills include an unprecedented federal health insurance mandate. This means that regardless of whether or not you want health insurance, you will be forced to buy it. Penalties for non-compliance include hefty fines or jail time. Wondering where they get that authority? They’d rather you not ask.

Neither the Obama administration, which has given tacit approval, nor the Congressional leaders who’ve advanced it have produced a credible Constitutional basis for this insurance mandate. Attempts to justify it using the “Commerce Clause,” or the “general welfare” provisions of our Constitution are absurd and completely ahistorical.

The taxpayer funded “public option” being advanced in Congress is designed not to compete with private insurers, but to ultimately put them out of business. The President and his advisers have admitted that passage of a “public option” is an incremental step toward “single payer” socialized medicine. By giving authority to HHS (the Senate’s plan) or the new “Health Choices Commissioner” (the House plan) to dictate what must be included in private insurance plans, it’s easy to see that even with out passage of a “public option” the push is on for complete federal control of health care.

As more and more Americans are swept into some form of government insurance, we will become increasingly dependent on the federal government. We’re being asked to trade our freedom and personal responsibility to make health care decisions for our families, for the false security of a health care system run by unelected bureaucrats. But as history has shown us, when we trade liberty for security, in the end we get neither.

Our health care system needs reform. But I believe we can do so with pro-market solutions that empower Americans, not the government. By increasing competition, we can make health care more affordable and more transparent. By giving individuals and families the same tax deductions that businesses receive when purchasing health insurance, we can make it portable and secure. These reforms don’t require the massive expansion of government being proposed by Congress and the White House, and they don’t require us to give up the essential freedom to do what we believe is best for ourselves and our families.

Self governance is at the heart of the American experiment. If we’re still committed to that ideal, then we must reject Obamacare. Jefferson said it best, “dependence begets servitude.”

Peg Luksik on the Healthcare bill (part 3 of 4)

Peg Luksik on the Healthcare bill (part 3 of 4)

Grading the President

“I have to tell you that I think that this president has failed. And the reason why I think this president has failed is because you look at the stimulus package. He said that, “If you pass my stimulus package, unemployment will stay below 8 percent.”

In the state of Florida, we have unemployment that’s about 11 percent or a little bit higher.

You look at the fact that now we have this cap-and-trade bill that is sitting out there, which is nothing but behavior modification through taxation, trying to force Americans to go to this green agenda.

No one talked about the fact that in this year under the Obama administration you’ve seen the highest casualties in Afghanistan. And the fact that it took him almost 90 days to figure out what his strategy is going to be was absolutely appalling.

We still are not talking about illegal immigration. We’re still not talking about energy independence. And I guess this president believes that job creation is giving 22 staffers to his wife.”
